How mediation works with Magnolia ADR
Discover our straightforward and effective mediation process designed to help you find common ground and lasting solutions.
Our mediation approach
Think of your mediator as a neutral guide for tough conversations. Instead of a judge deciding who wins or loses, we help people who are stuck in a dispute talk to each other, understand the real issues, and create their own lasting solutions.
Here is exactly what a Magnolia ADR mediator does to help:
Create a safe space
We provide a calm, confidential setting where everyone can speak without being interrupted and feel heard.
Parties can have a private session or a joint session, depending on their situation and needs. We also offer Zoom style meetings, so you never have to leave your favorite place.
Improve communication
Your mediator will act as a translator or moderator when things get heated, helping parties rephrase complaints into needs to truly hear each other and work towards a peaceful resolution.
Identify core interests
Your mediator can help people move past their rigid positions (what they say they want) to uncover their underlying interests (what they actually need) and determine a potential compromise.
Brainstorm solutions
Your mediator will then guide both sides to brainstorm creative solutions that address both sides' concerns, aiming for a fair win-win outcome. We focus on needs over wants and the future over the past.
Focus on the future
Instead of dwelling on blame or resentment, your mediator will keep the conversation focused on practical steps to resolve the dispute and look for the clear skies ahead. It is not about what happened or who did what. It is about what we can do to move forward and reach an agreement that both parties can live with.
The mediation process with Magnolia ADR
From initial contact to final agreement, our mediation steps are designed for clarity and resolution.
Step 1: Arrange a meeting
Your first step is to arrange an initial meeting with Magnolia ADR. This allows us to understand your situation and discuss if and how non-attorney, private mediation can best serve your needs. We are available Monday thru Friday 9a-4p. However, if you are in need of time outside of regular office hours, please let us know and we can work with you to set up a time that is convenient with your schedule. We offer Zoom style meetings so you can choose wherever you feel most comfortable.
Step 2: Sign agreement to mediate
Once you decide to proceed, both parties will sign an agreement to mediate. This document outlines the terms of confidentiality, impartiality, and commitment to the mediation process.
Step 3: Discuss issues and solutions
During mediation sessions, your mediator will facilitate an open and respectful discussion about the issues at hand. We will explore various perspectives and brainstorm potential solutions together. We strip away the courtroom theater and identify shared priorities- like protecting your children or business assets or saving thousands in legal fees- we build a practical, mutually beneficial path forward. We offer joint or private sessions, so that everyone has a chance to share their needs and hopes for resolve.
Step 4: Reach an agreement
The ultimate goal is to reach a mutually acceptable agreement. The final agreement will be documented and can then be signed by both parties, providing a clear path forward. If desired or required, depending on the type of mediation, parties are then responsible for filing their documents with the appropriate court within the appropriate time (such as an uncontested divorce).
Who can benefit from mediation?
Our mediation services are ideal for parties ready to work together towards a peaceful and lasting resolution.
Open to hearing both sides
Our services are for cooperative parties who are open to hearing both sides of an issue and are genuinely looking to understand different perspectives and brainstorm options to resolve the matter.
Intention to resolve
Mediation is best suited for those who come with a clear intention to resolve their dispute and are committed to finding common ground while wanting to be involved in the outcome rather than leaving their fate to a stranger in a black robe.
Not for everyone
It's NOT for those unwilling or unable to reach an agreement, or who require a judge to make decisions, force a resolution, or enforce obligations. For those types of cases, it is always recommended to seek legal counsel and follow the traditional litigation process. Unfortunately, that type of case costs more money and time because the additional legal advice and court time is needed.
Benefits of choosing mediation
Beyond avoiding court, discover the positive outcomes and advantages of resolving disputes with Magnolia ADR.
Both sides will be heard
In mediation, both parties have the opportunity to fully express their perspectives and concerns, ensuring a balanced discussion and understanding. YOU say what you need to say and everyone listens. Unlike in traditional courtroom litigation, where your legal representative speaks for you to the judge, who then makes all the decisions.
Mutual satisfaction
The goal of mediation is to find common ground where both sides give a little to reach an agreement they can both be happy with, leading to greater long-term satisfaction.
We start off with the parties (usually) splitting the cost of mediation evenly between them. This ensures both sides are financially invested in reaching an agreement.
Save time and money with private mediation
